How to Obtain Your Medical Records

To begin your medical malpractice claim, you will need to obtain a copy of any medical records relating to your injury. As a patient, you have the legal right to obtain these by making a written request and presenting it to the medical facility where your injury occurred.

Keep in mind that it takes time to process this request, and you may be required to make multiple requests in different areas. For instance, the doctor you treated you will have a record of any medications prescribed for your injury, but the pharmacy will probably have a record of any adverse side effects you reported.

In your written request, be sure to include:

  • Your name, spelled correctly (and any other names you may have gone by when you received treatment)
  • Your date of birth
  • Your social security number
  • Your patient number, if you know it (the account number on your billing statement is not necessarily your patient number)
